Ανακοίνωση προς τους πρόσφυγες για τις αποφάσεις της Ε.Ε. και τη συμφωνία με την Τουρκία

Παρακάτω είναι η ανακοίνωση σε 4 γλώσσες

Φίλοι πρόσφυγες και μετανάστες,

Σε συμβούλιο τους στις 17-18 Μάρτη οι πρωθυπουργοί των χωρών της Ευρωπαϊκής Ένωσης  και σε συμφωνία τους με την Τουρκία αποφάσισαν μέτρα  που αντιμετωπίζουν τους πρόσφυγες ως υπεράριθμους, που πρέπει να μείνουν στην πλειοψηφία τους εκτός της Ευρώπης. Τα μέτρα αφορούν όλους αδιακρίτως της χώρας προέλευσης. Το κείμενο των συμπερασμάτων της συνόδου και η συμφωνία με την Τουρκία επιβεβαιώνει τη βούληση των κρατών –μελών της ΕΕ  «να επανακτηθεί ο έλεγχος των εξωτερικών συνόρων» και να μπει τέλος στην «παράτυπη μετανάστευση» από την Τουρκία στην ΕΕ. Καλούνται δε τα κράτη των Δυτικών Βαλκανίων να συνεργαστούν για τη διαχείριση της κρίσης. Συγκεκριμένα οι αποφάσεις αναφέρουν:

1. Όσοι φτάνουν από την Τουρκία στα ελληνικά νησιά  από τις  20 Mάρτη 2016 θα καταγράφονται υποχρεωτικά σε ειδικά κέντρα φιλοξενίας που θα είναι κλειστά.

2. Όσοι δεν υποβάλλουν αίτηση ασύλου στις ελληνικές αρχές, θα θεωρούνται «παράτυποι μετανάστες» και θα επιστρέφονται αμέσως στην Τουρκία. Μέχρι να επιστραφούν θα κρατούνται σε κλειστά κέντρα κράτησης.

3. Όσοι υποβάλλουν αίτηση ασύλου θα εξεταστούν με πολύ συνοπτικές διαδικασίες. Σε κάθε περίπτωση

η εξέταση των αιτημάτων θα γίνει σε εξατομικευμένη βάση με βάση το Διεθνές Δίκαιο.  Είναι ασαφές πώς θα ανταποκριθούν σε αυτό οι διοικητικοί μηχανισμοί, αφού ζητείται η εξέταση να ολοκληρωθεί σε πολύ σύντομο χρόνο. Πολύ περισσότερο που αυτή τη στιγμή υπάρχει ήδη μεγάλος φόρτος στην Υπηρεσία Ασύλου.

4. Όσων οι αιτήσεις απορριφθούν θα επιστρέφονται στην Τουρκία.

5. Η νομοθεσία προβλέπει δυνατότητα δευτεροβάθμιας εξέτασης  σε περίπτωση που απορριφθεί  μια αίτηση ασύλου. Μέχρι να ολοκληρωθεί η εξέταση σε δεύτερο βαθμό μπορεί να ζητηθεί η αναστολή της επιστροφής σε  περίπτωση που η αναστολή δεν γίνεται αυτόματα.  Δεν διευκρινίζεται πότε και πώς θα γίνονται αυτά, όταν σήμερα μια παρόμοια διαδικασία ολοκληρώνεται σε αρκετούς μήνες.

6. Για κάθε ένα Σύριο που επιστρέφεται στην Τουρκία, θα μεταφέρεται στην Ευρώπη ένας άλλος Σύριος που δεν έχει επιχειρήσει να μπει στα ευρωπαϊκά σύνορα.

7. Η Συμφωνία ΕΕ – Τουρκίας κάνει ξεκάθαρη αναφορά μόνο  για επανεγκατάσταση  (resettlment) Σύριων προσφύγων, χωρίς  να αναφέρεται καθόλου σε πρόσφυγες από άλλες χώρες, όπως Ιρακινούς,  Αφγανούς, Παλαιστίνιους κλπ. Είναι ασαφές τι θα συμβεί με τους πρόσφυγες άλλων εθνικοτήτων.

8. Μέχρι 72.000 πρόσφυγες συνολικά έχει συμφωνηθεί ότι θα είναι αυτοί που θα  επανεγκατασταθούν από την Τουρκία. Πρόγραμμα μετεγκατάστασης θα υπάρχει και από την Ελλάδα για κάποιους από αυτούς που θα αναγνωριστούν ως πρόσφυγες. Υποτίθεται ότι τον μέσα στον επόμενο μήνα 6.000 μετεγκαταστάσεις από την Ελλάδα προς χώρες της ΕΕ θα έχουν ολοκληρωθεί κι άλλες 20.000 έως τα μέσα Μαΐου του 2016, την ώρα που από τον Οκτώβρη του 2015 μέχρι σήμερα έχουν πραγματοποιηθεί μόνο 900. 

9. Η Τουρκία πρόκειται να αναγνωριστεί ως «ασφαλής τρίτη  χώρα», δηλαδή ως  χώρα όπου υπάρχουν νομικές εγγυήσεις και επομένως  μπορούν να προωθηθούν όσοι μπορεί να  δικαιούνται  διεθνή προστασία. Η Τουρκία όμως δεν είναι ασφαλής ούτε για τους δικούς της πολίτες (βομβαρδισμός και εκτελέσεις Κούρδων, απαγόρευση κομμάτων που παίρνουν 11%, κτύπημα απεργιών, συλλήψεις πανεπιστημιακών, κλείσιμο εφημερίδων κλπ.). «Η Τουρκία δεν είναι ασφαλής χώρα, επιστροφές εκεί δεν ευσταθούν νομικά και ηθικά», τονίζει η Διεθνής Αμνηστία.

10. Ακόμα πιο  επικίνδυνο είναι πως η Συμφωνία ανάβει το πράσινο φως για να εντείνει η Τουρκία την επέμβασή της στη Συρία, στις περιοχές των συροτουρκικών συνόρων, με πρόσχημα την αποκατάσταση της ασφάλειας αλλά  με βασικό στόχο να κτυπήσει τους Κούρδους.

Οι κυβερνήσεις των χωρών της Ε.Ε. εφαρμόζουν πολιτικές ενάντια στους πρόσφυγες και υπηρετούν το κλίμα ξενοφοβίας και ρατσισμού, που καλλιεργεί η οικονομική ολιγαρχία και οι φασίστες, ότι δήθεν οι πρόσφυγες είναι απειλή για την ασφάλεια των ευρωπαίων, όταν οι ίδιοι προξενούν πολέμους, ιμπεριαλιστικές επεμβάσεις,  υποδαυλίζουν θρησκευτικούς και εθνικούς ανταγωνισμούς, καλλιεργούν το φανατισμό, εξέθρεψαν τον ISIS.

Αντίθετα ο λαός της χώρας μας, σας θεωρεί καλοδεχούμενους, θέλει να σταματήσουν οι πόλεμοι και ο ξεριζωμός, παλεύει ενάντια στο ΝΑΤΟ και τις αντιπροσφυγικές πολιτικές των κυβερνήσεων και της Ε.Ε.

Θέλουμε να αγωνιστούμε μαζί σας για να ανοίξουν τα σύνορα για ασφαλή και απρόσκοπτη διέλευση των προσφύγων, να μην υπάρξουν απελάσεις και φυλακίσεις,  να δοθεί άσυλο και προστασία σε όλους, που το ζητούν. Για όσους θέλετε να μείνετε είτε μόνιμα, είτε προσωρινά να υπάρξουν ανθρώπινες συνθήκες για τη διαμονή σας, τη σίτιση, την περίθαλψη, την πρόνοια που χρειάζεστε.

Ο πόλεμος είναι ο κοινός εχθρός μας. Η εργατική τάξη, η νεολαία, τα φτωχά λαϊκά στρώματα της χώρας μας σας υποδεχόμαστε και υποσχόμαστε με όλες μας τις δυνάμεις να υπερασπίσουμε τα δικαιώματά σας.

في اجتماعهم في ١٧-١٨ اذار قرر رؤساء حكومات دول التحاد الاوروبي وباتفاق مع تركيا اجراءات التي تعتبر رقم اللاجئين كبير جدا ويجب ان يبقى اغلبهم خارج اوروبا. هذه الاجراءات يسري مفعولها على الجميع بغض النظر عن الدول التي قدموا منها. استنتاجات اللقاء والاتفاق مع تركيا يؤكدون هدف دول الاتحاد الاوروبي "لاستعادة التحكم بالحدود الخارجية" ولوضع نهاية "للهجرة الغير قانونيه" من تركيا الى الاتحاد الاوروبي. ويطلبون من دول غرب البلقان المشاركة في ادارة الازمة.

القرارات يذكرون بشكل خاص:

１. الذين يصلون من تركيا الى الجزر اليونانية من تاريخ ٢٠/٣./٢٠١٦ سيسجلون بشكل اجباري في مراكز استضافة خاصة التي ستكون مغلقة.

２. الذين لا يقدمون طلب لجوء للسلطات اليونانية، سيعتبرون "مهاجرين غير قانونيين" وسيرجعون حالا الى تركيا. وحتى يتم ارجاعهم سيحتجزون في مراكز احتجاز مغلقة.

３. الذين يقدمون طلب لجوء سيدرس امرهم بإجراءات موجزة. في كل الاحوال فحص الطلبات سيتم بشكل شخصي وحسب القانون الدولي. انه غير واضح كيف سيستطيعون اجهزة الادارة تلبية هذا، في حين المطلوب هو انهاء الفحص خلال فترة قصيره جدا. وخصوصا ان مكتب خدمة اللجوء لديه في الوقت الحالي عمل كثير جدا.  

４. الذين ترفض طلباتهم سيرجعون الى تركيا.

５. القانون يعطي امكانية الاستئناف للفحص في درجة ثانية في حالة رفض طلب اللجوء. وحتى ينتهي الفحص في الدرجة الثانية من الممكن ان يقدم طلب تعليق الارجاع في حالة ان تعليق الارجاع لم يتم بشكل تلقائي. لا يوجد توضيح متى وكيف سيتم هذا، في حين اليوم مثل تلك الحالات تحتاج لعدة اشهر حتى اكمالها.

６. لكل سوري يرجع الى تركيا،  سينقل الى اوروبا سوري اخر الذي لم يحاول دخول الحدود الاوروبية.

７. الاتفاق بين الاتحاد الاوروبي وتركيا يذكر بشكل واضح فقط اعادة توطين (resettlment) اللاجئين السوريين، بدون اي ذكر للاجئين من دول اخرى، مثل العراقيين، الافغان، الفلسطينيين الخ. انه غير واضح ماذا سيحصل مع اللاجئين من الجنسيات الاخرى.

８. حتى ٧٢ الف لاجئ بالمجموع، اتفق انه سيتم توطينهم من تركيا. سيكون هناك برنامج توطين من اليونان لبعض من المعترف بهم كلاجئين. من المفروض انه خلال الشهر القادم سيتم نقل ستة الاف لاجئ من اليونان الى دول الاتحاد الاوروبي وعشرين الف حتى شهر ايار ٢٠١٦، في حين انه من شهر ١٠/٢٠١٥ وحتى اليوم تم تنفيذ ٩٠٠.  

９.   سيعترف بتركيا "كدولة ثالثة امنة"، ما يعني، كدولة التي تضمن الحقوق القانونية وبهذا من الممكن توجيه الذين يحصلون على حق الحماية الدولية. تركيا ليست امنة ولا حتى لمواطنيها (تفجير واعدام اكراد، حظر احزاب التي تحصل على ١١٪، ضرب الاضرابات، اعتقال جامعيين، اغلاق الصحف الخ). " تركيا ليست دولة امنة، الارجاع لهناك ليس له اساس لا قانوني ولا اخلاقي" توضح منظمة العفو الدولية.

１０.                واكثر خطرا، ان هذا الاتفاق يعطي الضوء الاخضر لتركيا لتكثيف تدخلها في سوريا، في مناطق الحدود السورية - التركية، تحت ستار اعادة الامان ولكن بالهدف الاساسي لضرب الاكراد.

حكومات دول الاتحاد الاوروبي ينفذون سياسات ضد اللاجئين ويخدمون جو كراهية الاجانب والعنصرية، التي ترعاها حكم الاقلية المسيطرة اقتصاديا والفاشيين، وكئن اللاجئين هم خطر على سلامة الاوروبيين، حين هم بذاتهم يسببون حروب، تدخلات امبريالية، يؤججون التطرف الديني، رعوا وكبروا الدولة الاسلامية (ISIS).

بالعكس، فان شعب بلدنا يرحب بكم، يريد ان تنتهي الحروب والترحيل، يناضل ضد حلف شمال الاطلسي (NATO) وضد سياسات الحكومات والاتحاد الاوروبي المناهضة للاجئين.

نريد ان نناضل معكم لفتح الحدود من اجل مرور اللاجئين الحر والامن، من اجل عدم الترحيل والسجن، لمنح اللجوء والحماية للجميع، الذين يطلبونه. للذين تريدون البقاء اما بشكل دائم او بشكل مؤقت يجب ان توفر لكم ظروف انسانية للإقامة، للتغذية، للرعاية الصحة، للعناية التي تحتاجون.

الحرب هو عدونا المشترك. الطبقة العاملة، الشباب، طبقات الشعب الفقيرة في بلدنا نرحب بكم ونوعدكم بان ندافع عن حقوقكم بكل قوانا.

Our fellow and friends, refugees and immigrants,

In their council in 17-18 March the prime ministers of the European Countries, and in their agreement with Turkey, have decided certain measures which deal with the refugees as an overflow, who must in their majority stay outside Europe. The measures concern everyone, irrespective of country of origin. The text with the conclusions of the council and the agreement with Turkey confirm the willing of the EU states “to regain control of the external borders” and to end “illegal immigration” from Turkey towards the EU. The states of the Western Balkans are called to cooperate in order to manage the crisis. Their decisions include:

1.  Those who arrive from Turkey into the Greek islands after the 20th of March will be obligingly registered in the special accommodation centers, which will be closed and not open.

2. Those who do not apply for asylum in the Greek authorities, will be thought of as “illegal immigrants” and will immediately be sent back to Turkey. Until their return, they will be held in closed detention centers.

3.  Those who do apply for asylum, will be examined in very quick and brief proceedings. In any case, the examination of the demands will be individualized, based on International Law. It is unclear how the administrative services will manage to cope with all this work, since examination of each case must be concluded in a very short period of time. Even more, even today the Asylum services deal with a great workload.

4.  Those whose demands for asylum will be rejected, will be forced to return to Turkey.

5.  The legislation provides the possibility of an appeal in the case of a rejected asylum application. Until the examination of this appeal, the forced return to Turkey may be requested or automatically suspended. It is completely unclear when and how this process will be effectuated, while before the council, such a process requires several months.

6.  For each Syrian who will be forcibly returned to Turkey, another Syrian will be resettled in the EU, as long as he/she will not have tried to enter the EU borders him/herself before.

7. The EU-Turkey Agreement clearly refers only to the resettlement of Syrian refugees, without referring at all to refugees coming from other countries, such as Iraqis, Afghans, Palestinians etc. It is unclear what will happen with the refugees with different nationalities.

8.  Refugees who will be resettled from Turkey in the EU will reach only 72,000. There will be another resettlement program for some of those who are currently in Greece and will be identified as refugees. Supposedly, until next month, 6,000 resettlements will be effectuated, from Greece to other EU countries. Another 20,000 resettlements will be effectuated until mi-May 2016. However, it is unclear how will this be possible, given that since October 2015 and up until today, only 900 have been effectuated.

9.  Turkey is about to be recognized as a “safe third country”, meaning as a country where legal guarantees exist and thus, people who have a right for protection can be transferred to. However, Turkey is not safe, not even for its own citizens (bombings and executions of Kurdish people, restriction of parties which represent the 11% of the electorate, repression against strikes, arrests of academics, shutdown of newspapers etc.) According to the International Amnesty, “Turkey is not a safe country, thus resettlements of people in Turkey are not justified, both legally and morally”.

10. What is even more dangerous, the Agreement paves way for Turkey to intensify its military intervention in Syria, in the Syrian-Turkish border, on the pretext of restoring security, but actually having as its main aim to attack the Kurds.

The EU governments apply their politics against the refugees and serve a climate of xenophobia and racism, cultivated by the economic oligarchy and fascists. They claim that refugees are supposedly a threat for Europeans' security, when it is actually themselves who provoke wars and imperialist interventions, incite religious and national antagonisms, cultivate fanaticism and nourish the ISIS.

The Greek people, on the contrary, welcomes you in Greece, requires for the wars to stop, fights against the NATO and the counter-refugee policies of the governments and the EU.

We want to fight by your side in order for the borders to open, for a safe and smooth crossing of the refugees, against expulsions and imprisonment, for asylum and protection to be provided to all those who ask for it. For you who want to stay here, either temporarily or permanently, we demand human conditions for your stay, food, healthcare, and every provision you need.

Our common enemy is the war. The working class, the youth, the poor people of Greece welcome you and promise that we will fight with all our strength to protect your rights.

Amis réfugiés et migrants,

Au Sommet du Conseil de l’Europe les 17 et 18 Mars, les chefs d’états ou de gouvernement européens, en accord avec la Turquie, ont décidé de prendre des mesures pour garder la majorité des réfugiés en dehors de l'Europe, considérant leur nombre beaucoup trop important. Les mesures sont applicables à tous, sans distinction, indépendamment du pays d'origine des réfugiés. Les conclusions du sommet et l'accord avec la Turquie confirment la volonté des Etats membres de l'UE de «reprendre le contrôle des frontières extérieures» et de mettre fin à «l'immigration irrégulière» de la Turquie vers l'UE. Ils invitent, même, les pays des Balkans occidentaux à travailler ensemble pour gérer la crise. Plus précisément, les décisions prises sont présentées ci-dessus:

1. Ceux qui arriveront de la Turquie aux les îles grecques à partir du 20 Mars 2016 seront enregistrés obligatoirement dans des centres d'hébergement fermés.

2. Ceux qui ne déposeront pas une demande d'asile aux autorités grecques, seront considérés comme des «migrants irréguliers» et seront immédiatement renvoyés en Turquie. Jusqu'à leur expulsion en Turquie, ils seront détenus dans des centres de détention.

3. Pour les demandeurs d'asile, la procédure d’examen des dossiers sera très sommaire. Dans tous les cas, l'examen des demandes sera fait individuellement, conformément au Droit International. On ne sait pas comment les mécanismes administratifs pourront gérer la situation, puisque l'examen devra se faire dans un délai très court, d'autant plus qu’en ce moment le Service d’Asile est débordé.

4. Les personnes dont les demandes seront rejetées, seront renvoyées en Turquie.

5. La législation prévoit la possibilité de réexamen d’une demande d'asile qui est rejetée. Dans ce cas, la personne concernée a le droit de présenter un recours devant l’Autorité d’Appel. Jusqu'à ce que l'examen au second degré soit complété, le refoulement vers la Turquie peut être suspendu, soit après la demande de l’intéressé, soit automatiquement. La procédure et sa durée ne sont pas spécifiées, et il faut savoir qu'à l’heure actuelle cette procédure dure plusieurs mois.

6. Pour chaque Syrien renvoyé en Turquie, un autre Syrien, qui n'a pas tenté d'entrer en Europe de façon irrégulière, sera transporté vers l'Europe.

7. L'accord UE - Turquie fait clairement référence à la réinstallation (resettlment) dans l’Union Européenne des réfugiés Syriens seulement, sans faire aucune mention aux réfugiés en provenance d'autres pays, tels que les Irakiens, les Afghans, les Palestiniens, etc. Il n’y a pas de précision sur ce qu’il adviendra des réfugiés d'autres nationalités.

8. Il a été convenu que 72.000 réfugiés au total soient réinstallés à partir de la Turquie. Un programme de réinstallation à partir de la Grèce sera aussi mis en place pour certains d'entre eux, qui seront reconnus officiellement comme réfugiés. Il parait que, 6000 réinstallations dans le prochain mois et 20 000 autres d'ici la mi-mai 2016 auront été achevés, à partir de la Grèce vers les pays de l'UE, tandis que depuis Octobre 2015 jusqu’ à ce jour 900 réinstallations seulement ont été effectuées.

9. La Turquie sera reconnue comme un «pays tiers sûr», à savoir comme un pays où il existe des garanties juridiques et, par conséquent, peuvent y être renvoyés ceux qui auraient droit à une protection internationale. La Turquie n’est toutefois un pays sûr, même pas pour ses propres citoyens (bombardements et exécutions de kurdes, interdiction des partis politiques qui obtiennent 11% de suffrage aux élections, répression des grèves, arrestations d’universitaires, interdiction de journaux, etc.). «La Turquie n’est pas un pays sûr, le refoulement des réfugiés vers la Turquie sont sans fondement juridique et moral», déclare l’Amnistie Internationale.

10. Ce qui est encore plus dangereux est le fait que l'Accord allume le feu vert pour que la Turquie intensifie son intervention en Syrie, dans les zones frontalières Turco-syriennes, sous prétexte de rétablir la sécurité, mais avec l'objectif principal de combattre les Kurdes.

Les gouvernements des pays de l'UE mettent en œuvre des politiques contre les réfugiés et créent une ambiance de xénophobie et de racisme, favorisée par les oligarques économiques et les fascistes, sous prétexte que les réfugiés constituent une menace pour la sécurité européenne, alors que ce sont bien eux-mêmes qui provoquent des guerres, mènent des interventions impérialistes, incitent le fanatisme religieux, ont engendré l'ISIS.

Contrairement à cela, le peuple grec vous souhaite la bienvenue. Le peuple grec exige que les guerres et le déracinement des gens s’arrêtent immédiatement et lutte contre les politiques de l'OTAN et les politiques anti- réfugiés des gouvernements et de l'UE.

Nous voulons combattre avec vous pour l’ouverture des frontières, pour le franchissement des réfugiés en toute sécurité et sans entrave, contre les expulsions et les emprisonnements, pour que l'asile et la protection soient accordés à tous ceux qui le demandent. Pour ceux parmi vous qui souhaitez rester en Grèce, en permanence ou temporairement, nous demandons des conditions humaines pour votre séjour, de l'alimentation, des soins de santé, de la protection sociale dont vous avez besoin.

Notre ennemi commun est la guerre. Nous, la classe ouvrière, la jeunesse, les couches populaires pauvres de notre pays, vous accueillons et promettons de défendre vos droits de toutes nos forces.
